Scholars of the nineteenth-century race sciences have tended to identify the period from c.1820– c.1850 as a phase of transition from philologically to physically focused study. In France, the physiologist William Frédéric Edwards is normally placed near the center of this transformation. A reconsideration of Edwards’ oeuvre in the context of his larger biography shows that it is impossible to see a clear-cut philological to physical “paradigm shift.” Although he has been remembered almost solely for his principle of the permanency (...) of physical “types,” Edwards was also committed to what he recognized as the new science of “ linguistique” and proposed a new branch of comparative philology based on pronunciation. Bearing Edwards’ attention to linguistics in mind, this article reconstructs his racial theories in their intellectual contexts and suggests that at a time of emergent disciplinary specialization, Edwards tried to hold discrete fields together and mold them into a new “natural history of man.”. Philosophers have lately seized upon Sperling's partial report technique and subsequent work on iconic memory in support of controversial claims about perceptual experience, in particular that phenomenology overflows cognitive access. Drawing on mounting evidence concerning postdictive perception, I offer an interpretation of Sperling's data in terms of cue-sensitive experience which fails to support any such claims. Arguments for overflow based on change-detection paradigms (e.g. Landman et al., 2003; Sligte et al., 2008) cannot be blocked in this way. However, such paradigms (...) are fundamentally different from Sperling's and, for rather different reasons, equally fail to establish controversial claims about perceptual experience. (shrink)

This article puts forward a theory of corporate criminal responsibility as the shared responsibility of the members of a team for wrongdoing committed by one of their number in the pursuit of their common goals. The theory of team member responsibility advanced in this article differs from theories—such as those of Peter French and Phillip Pettit—under which corporate or group responsibility is viewed as the responsibility of the corporation or group as an autonomous moral person. Instead, this article defends a (...) conception of a collectivity as a kind of relationship among individuals; under this conception, a collectivity is something more than the sum of its members, but not something having an autonomous existence apart from its members. To develop this idea, the article employs the concept of a team. Where individuals participate in a team, doing their part towards a collective goal, they are entitled to share in the credit for the positive achievements resulting from their combined actions, and they also share in the discredit for negative achievements of the group. This is so for each member, regardless of whether the member's individual contribution was a but-for cause of the group's achievement. Further, in the specific case of corporate teams, team member responsibility can help to explain why there should be liability of the corporate entity for crimes committed by members of the corporation (a group which typically includes its employees, officers, directors and, in some circumstances, its shareholders) in the pursuit of the corporation's goals. This study examines whether scenic beauty judgments based upon photographs of landscapes are similar to scenic beauty judgments based upon on-site experiences of landscapes. Two concerns are emphasized: a concern about the threat to the ecological validity of photo-based assessments caused by differences between on-site and photo-based contexts and a concern that the individual rater, rather than the group average, is the more appropriate unit of analysis for tests of validity of photo-based assessments. On-site scenic beauty assessments were collected from (...) day hikers. These data were compared to photo-based scenic beauty assessments collected from the same persons three months and nine months after their on-site experience. Approximately 38% of participants had insignificant correlations between their on-site and photo-based scenic beauty ratings. These and other results suggest that the validity of photo-based scenic beauty assessments is in doubt, at least for the situation studied here. Moreover, the results suggest that the difference between persons' on-site and photo-based ratings can be explained, in part, by contextual factors such as the mood, meaning, and novelty that differentiate photo-based from on-site landscape experiences. Group averaged on-site and photo-based assessments, however, were very similar, suggesting caution may be in order for studies interpreting summary measures. (shrink)

Shepard's data concern confusability, but the theories proposed by Shepard and by Tenenbaum & Griffiths concern generalization, indicating a gap between theory and data. In lieu of an abstract, here is a brief excerpt of the content:69 WILLIAM ROBERTSON AND DAVID HUME: THREE LETTERS The relationship between David Hume and his fellow Scottish historian William Robertson has always seemed one-sided. Despite the existence of fifteen letters to Robertson in the standard volumes of Hume's correspondence,1 Hume scholars have long had reason to regret the lack of a single extant letter from Robertson to Hume. None are to be found, for example, where one would most (...) expect them to be — in the Royal Society of Edinburgh, alongside the letters to Hume from various other Moderate clergymen and literati in Robertson's circle, such as Hugh Blair and Adam Ferguson. Fortunately, however, two of Robertson's letters to Hume (numbered II and III below) have now turned up where one would not expect them to be — among Robertson's own correspondence in the Robertson2 Macdonald Papers, National Library of Scotland. They are not mere drafts, such as one is accustomed to find among an author's private papers; rather, they are autograph signed letters that appear to have actually been posted. How and when they found their way back to Robertson's personal papers, and what became of the rest of Robertson's letters to Hume, are questions open to speculation. For the moment we are grateful for the letters we now have, neither of which is known to have been published before in whole or in part. Nor has Hume been identified before as the recipient of either of these letters, though internal evidence makes it clear that he was. Both letters date from the late 1760s, when Hume was living in London and Robertson was at the peak of his multi-faceted career in Edinburgh as university principal, parish minister, ecclesiastical leader, and man of letters. The first of them, dated 27 March 1767, was sent to Hume in his capacity as under- 70 secretary of state in the Northern Department (an office he held from February 1767 to January 1768). It is plainly a reply to a letter of 19 March, in which Hume had discussed three topics to which Robertson was 5 responding: Robertson's efforts to secure a military chaplaincy for a certain Scottish minister (evidently named Brodie); Conway's role in the famous dispute between Hume and Rousseau; and the public response to Adam Ferguson's newly published Essay on the History of Civil Society. In addition Robertson addresses a matter that Hume had apparently broached with him at some earlier time: the attempt to find a suitable Scottish church to which Hume might obtain a crown presentation for his nephews' tutor, the Rev. Christopher Tait. The letter concludes on a note of admiration that is characteristic not only of Robertson but of most of Hume's other "Protestant Pastors" in Scotland. The second letter to Hume, dated 31 January 1769, is chiefly concerned with the forthcoming publication of Robertson's History of Charles V and the French translation of it by J.-B.-A. Suard — subjects that had been treated in two letters from Hume to 7 Robertson of autumn 1768. It also contains a strong recommendation for a bright young Scottish writer (in both the legal and literary senses of that term) who would one day become Robertson's most vitriolic critic: Gilbert Stuart. On the personal side, there is encouragement for the now unemployed Hume to return to Edinburgh, as he was then threatening to do, after his "great glut of society" at Paris and London, and there are allusions in the closing paragraph to Hume's part in introducing his friend to polite society when Robertson had visited London to arrange the publication of Charles V in the spring of 1768. 71 To these two letters from Robertson we have prefixed a third from earlier in the same decade, one Q not actually addressed to Hume but largely about him. BackgroundSocio-cultural perceptions surrounding death have profoundly changed since the 1950s with development of modern intensive care and progress in solid organ transplantation. Despite broad support for organ transplantation, many fundamental concepts and practices including brain death, organ donation after circulatory death, and some antemortem interventions to prepare for transplantation continue to be challenged. Attitudes toward the ethical issues surrounding death and organ donation may influence support for and participation in organ donation but differences between and among diverse populations have not (...) been studied.ObjectivesIn order to clarify attitudes toward brain death, organ donation after circulatory death and antemortem interventions in the context of organ donation, we conducted a scoping review of international English-language quantitative surveys in various populations.Study appraisalA search of literature up to October 2020 was performed, using multiple databases. After screening, 45 studies were found to meet pre-specified inclusion criteria.Results32 studies examined attitudes to brain death, predominantly in healthcare professionals. In most, around 75% of respondents accepted brain death as equivalent to death of the person. Less common perspectives included equating death with irreversible coma and willingness to undertake organ donation even if it caused death. 14 studies examined attitudes to organ donation following circulatory death. Around half of respondents in most studies accepted that death could be confidently diagnosed after only 5 min of cardiorespiratory arrest. The predominant reason was lack of confidence in doctors or diagnostic procedures. Only 6 studies examined attitudes towards antemortem interventions in prospective organ donors. Most respondents supported minimally invasive procedures and only where specific consent was obtained.ConclusionsOur review suggests a considerable proportion of people, including healthcare professionals, have doubts about the medical and ethical validity of modern determinations of death. The prognosis of brain injury was a more common concern in the context of organ donation decision-making than certainty of death. (shrink)

The practice of biobank networking—where biobanks are linked together, and researchers share human tissue samples—is an increasingly common practice both domestically and internationally. The benefits from networking in this way are well established. However, there is a need for ethical oversight in the sharing of human tissue. Ethics committees will increasingly be called upon to approve the sharing of tissue and data with other researchers, often via biobanks, and little guidance currently exists for such committees. BackgroundBiobanks provide an important foundation for genomic and personalised medicine. In order to enhance their scientific power and scope, they are increasingly becoming part of national or international networks. Public trust is essential in fostering public engagement, encouraging donation to, and facilitating public funding for biobanks. Globalisation and networking of biobanking may challenge this trust.MethodsWe report the results of an Australian study examining public attitudes to the networking and globalisation of biobanks. The study used quantitative and qualitative methods in conjunction (...) with bioethical analysis in order to determine factors that may contribute to, and threaten, trust.ResultsOur results indicate a generally high level of trust in biobanks and in medical research more broadly. Key factors that can reduce perceived trustworthiness of biobanks are commercialisation and involvement in global networking.ConclusionsWe conclude that robust ethical oversight and governance standards can both promote trust in global biobanking and ensure that this trust is warranted. In his testamentary letter to Auguste Chevalier, Évariste Galois states that, in modern terminology, the smallest simple group has order 60. No proof of this statement survives in his papers, and it has been suggested that a proof would have been impossible using the methods available at the time. We argue that this assertion is unduly pessimistic. Moreover, one fragmentary document, dismissed as a triviality and misunderstood, looks suspiciously like cryptic notes related to this result. We give an elementary proof (...) of Galois’s statement, explain why it is likely that he would have been aware of the methods involved, and discuss the potential relevance of the fragment. (shrink)

This article examines the English scholar James Cowles Prichard's attention to language and comparative philology within his wider project on the natural history of man. It reveals that linguistic evidence was among the most important elements for Prichard in his overarching scientific aim of investigating human physical diversity, and served as the evidential foundation for his ethnology. His work on Celtic comparative philology made him not only one of the earliest British adopters of German comparative grammar, but a comparative philologist (...) of European stature in his own right. More generally, linguistic evidence helped Prichard to keep his magnum opus, Researches into the Physical History of Mankind, as logically ordered as possible, and therefore to turn ethnology into a discipline with analytical aspirations on a global scale. In recent years, there has been a rapid growth in the use of autologous stem cell-based interventions to treat a wide range of medical conditions, including those for which there is limited evidence of safety and efficacy. One justification for this growth in the use of unproven interventions is that clinicians should be free to innovate, as long as consumers are adequately informed about risks and benefits. The nature of moral action versus moral judgment has been extensively debated in numerous disciplines. We introduce Virtual Reality (VR) moral paradigms examining the action individuals take in a high emotionally arousing, direct action-focused, moral scenario. In two studies involving qualitatively different populations, we found a greater endorsement of utilitarian responses–killing one in order to save many others–when action was required in moral virtual dilemmas compared to their judgment counterparts. Heart rate in virtual moral dilemmas was significantly increased when compared (...) to both judgment counterparts and control virtual tasks. Our research suggests that moral action may be viewed as an independent construct to moral judgment, with VR methods delivering new prospects for investigating and assessing moral behaviour. This paper argues that identity which is the locus of emotional and social phenomena of an individual becomes problematic particularly in postmodern society. Postmodern society calls for a socio-cultural and epistemological revolution which permeates the very core of our social existence. Coupled with the immensity and massive effects of the market industry, postmodern culture affects our lives through the dissolutions of boundaries, geographies, and our ethnicities so that our sense of personal and social identity is left into perpetual disintegration, struggles (...) and contradictions. The so-called “inner” and “outer” community which we once cherished inevitably dissolved into the arena of the market industry. Consequently, the sense of “I-am” which Fromm considers as an existential human need already deeply roots itself towards commodity fixations rather than in our group or in our ethnic communal relationships. It is in these contexts that this paper contends a necessity to redeem identity not only as a psychological base but more of an existential human need. Further, this paper maintains that Fromm’s notion of relatedness and rootedness are necessary elements in identity formation since they serve as the existential psychic cores that lead towards being truly at home amidst a fragmented social world.
